Terms and Conditions (T)<\/strong>

<\/p>

1. Scope of Application<\/strong><\/p>

These Terms and Conditions (T) apply to contracts for digital services and other offers between<\/p>

Pawdare e.V.<\/strong>Schopenhauerstr. 7180807 M\u00fcnchenGermany <\/p>

registered in the association register of the Munich District Court under VR 211693<\/strong><\/p>

\u2013 hereinafter referred to as “Pawdare” or “Provider” \u2013<\/p>

and the users of the website pawdare.com<\/strong> as well as the associated digital platform and services offered.<\/p>

Insofar as it concerns membership in Pawdare e.V., the currently valid articles of association and, if applicable, the contribution rules of the association shall take precedence. These T apply only supplementally to the extent that they are applicable. <\/p>

The T become part of a contract if the user was informed of their validity before the conclusion of the contract, had the opportunity to take note of their content, and agreed to their validity.

<\/p>

2. Services by Pawdare<\/strong><\/p>

Pawdare provides, in particular, digital offers, information, and services related to animals and animal welfare.<\/p>

These may include, among others:<\/p>

\u2022 digital tools and functions\u2022 digital animal and document management\u2022 community functions\u2022 information on animal health and animal welfare\u2022 search and placement functions\u2022 offers and information from partners\u2022 additional digital services\u2022 paid or free platform functions\u2022 offers and services for association members<\/p>

The nature and scope of the respective service result from the corresponding service or offer description on the website.<\/p>

Pawdare is entitled to further develop the platform technically and to adapt functions, provided that essential services already contractually agreed upon are not unreasonably restricted as a result.

<\/p>

3. Registration and User Account<\/strong><\/p>

The creation of a user account may be required for certain functions of the platform.<\/p>

The user undertakes to provide complete and truthful information during registration and to update this information in the event of changes.<\/p>

Access data must be treated confidentially and may not be passed on to third parties without authorization.<\/p>

If there is a suspicion of unauthorized use of the user account, Pawdare must be informed immediately.

<\/p>

4. Conclusion of Contract<\/strong><\/p>

The presentation of services on the website does not generally constitute a legally binding offer, unless expressly stated otherwise.<\/p>

By completing the respective ordering, booking, or registration process, the user submits a binding offer to conclude a contract.<\/p>

The contract is concluded when Pawdare expressly confirms the offer or activates or provides the ordered service.<\/p>

In the case of paid offers, the user will be shown the price, the scope of services, and, if applicable, the contract duration and termination conditions before the order is completed.<\/p>

For admission as a member of Pawdare e.V., the regulations of the articles of association and, if applicable, the contribution rules apply additionally and with precedence.

<\/p>

5. Offers and Services from Partners<\/strong><\/p>

Pawdare may present or broker offers, services, or information from external partners and third-party providers on the platform.<\/p>

Unless expressly stated otherwise, a contract for such services is concluded directly between the user and the respective third-party provider.<\/p>

In these cases, Pawdare itself does not become a contractual partner for the brokered service.<\/p>

The respective contractual terms of the third-party provider apply to the execution of such contracts.

<\/p>

6. Prices and Payment Terms<\/strong><\/p>

All prices stated on the website are in euros.<\/p>

Whether and in what amount taxes are included will be shown according to the respective legal and tax situation as well as the specific offer presentation.<\/p>

The available payment methods are displayed to the user during the respective ordering or booking process.<\/p>

In the case of recurring paid services, regular payments may be agreed upon. The price, payment interval, contract duration, and termination conditions will be displayed before the contract is concluded. <\/p>

Price changes generally apply only to future contracts or contract renewals, unless otherwise effectively agreed in the respective contract.<\/p>

For membership fees of Pawdare e.V., the articles of association and, if applicable, the contribution rules of the association apply.

<\/p>

7. Obligations of Users<\/strong><\/p>

The user undertakes in particular:<\/p>

\u2022 to provide truthful information during registration and use,\u2022 not to use the platform for illegal purposes,\u2022 not to distribute content that is illegal, offensive, or violates the rights of third parties,\u2022 not to introduce malware or other technically harmful content,\u2022 not to take any measures that could impair the operation or security of the platform,\u2022 to protect access data from access by unauthorized persons,\u2022 to respect the rights of third parties, in particular copyright, trademark, personal, and data protection rights.<\/p>

In the event of significant or repeated violations, Pawdare may remove content and temporarily restrict or block user accounts.<\/p>

Legal and contractual rights of the parties involved remain unaffected by this.

<\/p>

8. Availability of the Platform<\/strong><\/p>

Pawdare endeavors to ensure the highest possible and trouble-free availability of the website and platform.<\/p>

However, constant and completely uninterrupted availability cannot be guaranteed, in particular due to maintenance work, technical faults, security measures, or circumstances outside the control of Pawdare.<\/p>

Planned maintenance work will be carried out, as far as possible and reasonable, in such a way that impairments for users remain as low as possible.

<\/p>

9. Information on Animal Health and Animal Welfare<\/strong><\/p>

Information on the platform regarding animal health, care, nutrition, or comparable topics is generally for general information purposes.<\/p>

It does not replace an individual examination, diagnosis, or treatment by a veterinarian or another appropriately qualified professional.<\/p>

In the event of acute health problems or emergencies, a veterinarian or veterinary emergency service should be contacted immediately.<\/p>

Insofar as information from external providers or professionals is provided on the platform, it will be identified if this content does not originate from Pawdare itself.

<\/p>

10. Liability<\/strong><\/p>

Pawdare is liable without limitation for damages based on intentional or grossly negligent behavior by Pawdare, its legal representatives, or vicarious agents.<\/p>

Pawdare is also liable without limitation for damages resulting from injury to life, body, or health, insofar as these are based on an intentional or negligent breach of duty.<\/p>

In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the contractually typical and foreseeable damage.<\/p>

Otherwise, liability for damages caused by slight negligence is excluded to the extent permitted by law.<\/p>

Mandatory legal liability regulations remain unaffected.<\/p>

For services from third-party providers where Pawdare itself is not a contractual partner, the respective third-party provider is liable according to the legal and contractual provisions.

<\/p>

11. Contract Duration and Termination<\/strong><\/p>

The contract duration and termination conditions for paid digital services result from the respective offer description and the contractual terms communicated at the time the contract was concluded.<\/p>

The right of both parties to extraordinary termination for good cause remains unaffected.<\/p>

For the termination of membership in Pawdare e.V., the corresponding regulations of the articles of association and, if applicable, the contribution rules as well as the legal provisions apply.

<\/p>

12. Right of Withdrawal for Consumers<\/strong><\/p>

Consumers are entitled to a statutory right of withdrawal for distance contracts, provided that no statutory exclusion or premature expiry of the right of withdrawal is provided for.<\/p>

The consumer will be informed separately about the right of withdrawal, the withdrawal period, and the exercise of the right of withdrawal as part of the respective contract conclusion.<\/p>

For digital content and digital services, the statutory provisions provided for this purpose apply additionally.

<\/p>

13. Data Protection<\/strong><\/p>

Information about the collection, processing, and use of personal data is contained in Pawdare’s current privacy policy.

<\/p>

14. Changes to these T<\/strong><\/p>

Pawdare may change these T for future contracts.<\/p>

For already existing contractual relationships, changes only apply if there is a legal basis for this or if the change was effectively agreed between Pawdare and the user.<\/p>

The mere publication of a new version of these T does not automatically lead to a change in already existing contracts.

<\/p>

15. Applicable Law<\/strong><\/p>

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.<\/p>

With respect to consumers, this choice of law applies only to the extent that mandatory consumer protection regulations of the state in which the consumer has their habitual residence are not withdrawn.
